Equipment expertise in Ukraine.

       According to the Article 21 of the Law of Ukraine "On Labour Safety": • “An employer shall get a permit to start execution of high risk work and to operate (use) high risk vehicles, machinery and equipment (further - permit).”

• Expertise department executes expertise of enterprises and organizations on the opportunity to execute high-risk work on possibility of high-risk machines and machinery equipment operation

• Lists of types of work, machines, high-risk equipment, for which permit is required, are defined by the Decree of the Cabinet of Ministers of Ukraine on October 15, 2003 No. 1631

To receive the permit economic entity or authorized person submits the application for permit in the prescribed form to the Main Executive Authority on Supervision of Labor Safety and its territorial bodies.

Attach to application:
• Expert report on the possibility of economic entity to ensure compliance with the law during the execution of high-risk works.
• Expert report on the object conformity to the requirements of legal acts on labor and industrial safety (based on the results of certification in UkrSEPRO system, if any) and the possibility of economic entity to ensure compliance with the law during its operation.
• Operational documentation (copies of the operation manual, passports etc.) in Ukrainian or, exceptionally, in Russian (for products manufactured abroad).

Permit is issued by Main Executive Authority on Supervision of Labor Safety for an initial term of 3 years. In case of no complaints, re-permit is issued for a period of 5 years.

Also according to the Article 21 of the Law of Ukraine «In Labour Safety»:
“Technological processes, machinery, equipment, vehicles, chemicals and their compounds and other dangerous products purchased abroad are allowed to operation (use) only in case the examination on their compliance with safety regulations, valid on the territory of Ukraine, is conducted.”

Expertise department executes expertise of machines, equipment purchased/produced abroad for compliance with legal acts on labor safety, valid at the territory of Ukraine.

List of documents needed for expertise is approved by the Decree of the Main Executive Authority on Supervision of Labor Safety.
